The legal requirements

A marriage in Ireland is legally valid when the couple meet the legal requirements for marriage and the ceremony is performed by a person who is authorised to solemnise marriages. The key practical step is giving at least three months’ notice to a civil registration service. Both people normally attend a marriage notification appointment, where they make a declaration that they know of no legal impediment to the marriage.

The couple must also provide the required identity, birth, address and PPS documentation, together with details of the proposed ceremony, venue, witnesses and solemniser. The standard notification fee is €200. If the registrar is satisfied that everything is in order, a Marriage Registration Form (MRF) is issued.

The role of the solemniser

The solemniser is particularly important because a legal marriage ceremony must be performed by a registered solemniser. The person must appear on Ireland’s Register of Solemnisers. Depending on the type of ceremony, this may be a civil registrar or an authorised member of a religious or secular organisation.

A celebrant is therefore not automatically authorised to conduct a legally binding wedding. If you are choosing an independent celebrant for a secular or spiritual ceremony, check that they are registered as a solemniser before booking them for your legal ceremony.

The solemniser also has legal responsibilities during the ceremony. For example, the registered solemniser must be satisfied that the couple understand the nature of the marriage ceremony and the declarations being made.

What happens after the ceremony

For a religious or secular wedding, the completed Marriage Registration Form must be returned to a civil registration service within one month of the marriage. Civil marriages are registered by the registrar who conducts the ceremony.

There are also two witnesses, both of whom must be at least 18 on the wedding day. Once the marriage has been properly registered, you can order an official marriage certificate.

In short, choosing a registered solemniser, completing the notification process and correctly registering the marriage are central to making a wedding legally recognised in Ireland.
